This position is organized into major areas of responsibility with the duties detailed under each area. The job description is the basis for clarification and pay, recruitment and selection, and performance appraisal.


It is a management function to assign duties. Therefore, management has developed this job description based on the responsibilities for the position and not the individual. The supervisor will review this job description with the employee upon hiring. Management may revise this description if there are substantial changes in the duties or if management feels there is a need for an update. If this occurs, the employee will have an opportunity to provide input.


1. Title of Position: Regional Long Term Care Ombudsman (RLTCO)


Area IV and V Long Term Care Ombudsman Program Supervisor


2. Immediate Supervisor: Area V Agency on Aging (AAA) Director


The immediate supervisor is the position that assigns, directs, and evaluates the duties of this position. The immediate supervisor is the first step in the grievance process.


3. Summary of Position: The Regional Long-Term Care Ombudsman (RLTCO) serves as an effective advocate for the well-being of long-term care residents within a designated region. The RLTCO shall promote both individual and systemic complaint resolution activities, regular presence in long-term care facilities, volunteer recruitment and support, and consistent region wide reporting. This position includes responsibility for Area IV and Area V program administration and program supervision of the Area IV and Area V Local Long-Term Care Ombudsman Staff.


4. Duties and responsibilities of the position: Duties are described below.


A. Operational:


1. Receive and pass certification training as a Long-Term Care Ombudsman from the State Long Term Care Ombudsman within 6 months of employment.


2. Complete a minimum of sixty (60) hours of continuing education training annually according to SLTCOP policies.


3. Attending regular staff meetings (including regional quarterly) with the State Ombudsman.


4. Serve as Regional contact for local Ombudsman staff and in conjunction with local Ombudsman in Region (this includes Area IV & Area V) to provide additional coverage to facilities and to fill in when vacancies occur until the new ombudsman can be certified.


5. Assist and monitor LTCO based on the guidelines of the Annual Plan.


6. Serve as Program Supervisor for Area IV and Area V Agency Local Long-Term Care Ombudsman.


7. Develop and maintain cooperative working relationships with nursing facility administrators, assisted living facility (ALF) operators and their staff, and appropriate agencies such as Adult Protective Services, Home and Community Based Services, Office on Aging, Quality Assurance Division, Area Agencies on Aging in Region, and law enforcement agencies.


8. Keep abreast of all relevant long-term care issues affecting consumers of services, the implementation of applicable Federal, State, and local laws, regulations and policies.


9. Work within policies and procedures established by the State Ombudsman program and the Area V AAA director.


B. Local Ombudsman Support:


1. Serve as the regional contact for local ombudsman staff and volunteers. Act as mentor to newly hired/recruited ombudsman staff and volunteers.


2. Serve as program supervisor for Area IV and Area V LTCO staff.


3. Coordinate the work of local ombudsman and volunteers in visiting assigned facilities, investigating and resolving complaints, providing education and in-service training to facilities, residents, families and the community.


4. Review cases with local ombudsman, volunteers, and State Ombudsman to identify problem and issues that require further follow-up or interagency involvement for resolution.


5. In conjunction with and approval of the State Ombudsman and the AAA Director, provide volunteer and staff in-service training as necessary and up to date knowledge about appropriate issues.


6. Assist the AAA Directors in overseeing the work of their local ombudsman staff and volunteers in accomplishing and reporting assigned duties.


7. In conjunction with the AAA and the State Ombudsman Program, assess the need for, and in turn, create and coordinate regular, periodic activities for ombudsman staff and volunteers designed to recognize, motivate, nurture and validate their worth as members of the State Long-Term Care Ombudsman Program.


C. Recruitments:


1. Recruit, train, and supervise volunteers to increase presence in long-term care facilities as local ombudsman or friendly visitors.


2. Coordinate initial training for volunteer visitors and participate in these training sessions.


D. Education and Promotion:


1. Promote the regional program, in addition to the Area IV and Area V program, to increase awareness of and involvement with long-term care facilities.


2. In conjunction with the State Long-Term Care Ombudsman Program, coordinate, supervise and facilitate an educational component with local certified ombudsman and volunteers to mentor new recruits.


3. Provide information and technical assistance to staff, volunteers, providers and recipients of LTC services.


4. Assist residents and families with information and support in advocating for Residents Rights and the highest quality of care possible.


5. Develop and maintain cooperative working relationships with the media (for both recruitment and recognition) and various community organizations such as AARP, Montana Senior Citizens Association, Governor’s Advisory Council, RSVP, Foster Grandparent Program and other associations who may provide volunteers and other types of support.


6. Participate in the development and implementation of LTCOP advocacy efforts, community awareness, outreach, and education events. Assist long term care providers, agencies, local ombudsman staff and volunteers and others in becoming more responsive to the needs of long-term care residents.


7. Serves as an advocate for the agency and communities served.


8. Promotes the development of citizen organizations, such as resident and family councils, to give residents of long-term care facilities, and other interested parties, a voice in resident health, safety and policy making process.


E. Complaints:


1. Investigate, document and seek resolution of complaints on behalf of residents of long-term care facilities and/or provide assistance to local ombudsman in the investigation and resolution process.


2. With the consent of the residents, refer complaints, which come under other agencies jurisdiction for investigation.


3. Prepare and submit written reports on investigations to the State Ombudsman following established policies and procedures.


4. Communicate with state surveyors as to problem areas, as well as attending annual exit surveys when local LTCO requests.


5. Maintain the confidentiality of complaints and residents per federal statutes.


F. Reporting/Other


1. Maintain the regional reporting system to collect data related to complaints and activities of local LTCO within the region.


2. Maintain all records specific to Area V, co-developing program/grant budget(s) periodically as required and prepare justification thereof. Assists in planning process, developing applications for new projects or funding, recommends actions to the agency director. Works closely with the Area V director in planning and implementing budgets and programs specific to Area V as well as the regional budget.


3. Provide summary statistical and narrative reports per instructions from the State Ombudsman: utilize reporting system to generate monthly, quarterly and annual summary reports as required by the State Ombudsman and AAA Director.


4. Work in conjunction with the SLTCOP in monitoring complaints in order to identify long-term care patterns and issues in the region. Work with the SLTCO to analyze and develop policies and procedures to provide information and understanding to authorities charged with the operation and regulation of long-term care facilities.


5. Develop annual plan for the LTCOP in conjunction with Region AAA directors and Area LTCO supervisors.


6. Performs other related duties as assigned by supervisor.


5. Knowledge and abilities:


Knowledge of: the needs and problems of residents in long term care facilities and their families; the State and local long term care system; social service and public benefits programs related to the residents; medical and social process of aging; dispute resolution techniques, including investigation and negotiation; federal guidelines for all nursing facilities and state regulations for assisted living homes; and importance of Residents Rights.


Ability to:demonstrate organizational skills in complex workloads; facilitate interagency involvement in addressing systems problems; assist in supervising, supporting and training staff and volunteers; organize community groups; communicate effectively both orally and in writing; identify and analyze issues; evaluate complex problems and issues and solve them creatively under pressure; develop intervention strategies and implement appropriate problem solving techniques including negotiation and crisis management; collaborate with other agency programs to include I&A; and maintain a computerized data base for work activity reporting. Travel throughout Montana year around.


Background skills: good people skills; personnel management; knowledge of legal systems, long-term care facility issues and gerontology; networking; public speaking; understanding of existing human services resources, government systems and how they work.


6. Education and Experience:


The above knowledge, abilities and skills are typically acquired through a bachelor’s degree in nursing, social work, or other closely related field and one year of social service experience in the field of aging; or commensurate experience/education may substitute for the degree upon approval; or three years of social service experience with at least two years in the field of aging or geriatric long-term care. Ombudsman and supervisory experience preferred. Successful completion of Montana LTC Ombudsman training and certification process within allotted time frame.


7. Requirements:


· Must be free of conflict of interests, as defined by the Older Americans Act, which interfere or have the appearance of interfering with the Long-Term Care Ombudsman’s responsibilities. In particular must not have been an owner, administrator or employee in any capacity with a long-term care facility within two years prior to appointment.


· Must have no financial interest in the provision of long-term care services,


· Must have an acceptable mode of transportation, appropriate vehicle insurance, valid Montana driver’s license, freedom and willingness to travel.


· Must be a resident of the region served by the Regional Long Term Care Ombudsman program or be willing to move.


· Must be able to work in stressful situations and be able to work in nursing homes and assisted living facilities.


8. PHYSICAL DEMANDS & WORKING CONDITIONS:


Considerable year around travel will be required throughout Southwestern Montana, especially the twelve counties comprising the service region of this position. Must have the ability to sit, stand, walk, hear, speak in front of diverse groups, drive an automobile and use computers in fulfilling the requirements of this position.
