The Construction Industries Division protects consumers by regulating the industry through policies that promote business growth, safety, and general welfare of the public. The division strives to provide excellent customer service, every time, while:
Ensuring that construction is performed in a safe, competent, and professional manner
Licensing contractors and enforcing licensing laws
Requiring licensure for any person practicing or offering to practice construction contracting
Enforcing the laws, regulations, and standards governing construction contracting in a fair and uniform manner
Providing resolution to disputes that arise from construction activities
Interviews are anticipated to be conducted within two weeks of the closing date.
Why does the job exist?
This position investigates and prosecutes unlicensed contractors for violations of the New Mexico Construction Industries Licensing Act and the Manufactured Housing Act. The position is both investigative and prosecutorial. This position investigates alleged unlicensed contracting; collects evidence; conducts computer related research develops and maintains close working relationships with law enforcement agencies and court staff; files criminal complaints in both metropolitan and magistrate courts throughout the state; prepares and provides discovery; and represents the agency at hearings and trials. A working knowledge of the rules of criminal court, court room procedure, and motion practice is necessary for this position.
How does it get done?
This position manages their own caseload in Salesforce; tracks information; investigates criminal violations; works with trade bureaus; is a critical part of a statewide team; and works with local jurisdictions on incidents of unlicensed contracting. Report writing and the ability to write a probable cause statement are key skills. This position also requires the writing of pleadings, motions and plea agreements, and speaks interactively in front of groups of people. Basic functionality in the Microsoft Office Suite is necessary. Familiarity with Odyssey and Salesforce is a plus.
Who are the customers?
The position will work with project owners, homeowners, licensed contractors, trade bureaus, local jurisdictions, attorneys, district attorney offices and the Attorney General's Office to prosecute unlicensed contractors.

Minimum Qualification
Bachelor's degree from an accredited college or university in Criminology, Criminal Justice, Police Science, or other related field, with a minimum of four (4) years of experience in criminal investigations, criminal court procedures, criminal investigative report writing, and court filings. Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling eight (8) years may substitute for the required education and experience.
Employment Requirements
Must be able to pass a preemployment background check and maintain a valid driver's license.
Working Conditions
Work is performed with exposure to Visual Display Terminal (VDT) and extensive personal computer and phone usage. Some sitting, standing, bending and reaching may be required. This position will work in and out of the office, statewide travel will be required.
